Partner Visa

Gaining a Partner/Spouse/De Facto visa in Australia is not as straightforward as many people believe it to be. There are different classes of visa depending on whether you’re lodging in Australia (onshore), or outside of Australia (offshore).

The process can be complex, which is why you will want to consider engaging Unicons Migration to help with your application.

We are in a relationship, how hard can it be to obtain a visa?

Partner visas are one of the most applied for visas and as such, have high refusal rate.

Proving on paper that you’re in a relationship is not as straightforward as you might think.

This is particularly true for anyone in a de facto relationship. Having a boyfriend or girlfriend is not the same as being in an actual de facto relationship.

There are many things that need to be considered before your application is lodged.

Are you eligible for a Partner visa?

There are two main paths for eligibility for a Partner visa in Australia.

  • You are married to an Australian citizen, Australian permanent resident, or eligible New Zealand resident at the time of application, or
  • You are in a de facto relationship (for a period of at least 12 months*) with an Australian citizen, Australian permanent resident, or eligible New Zealand resident at the time of application.

These paths are applicable for both heterosexual and same-sex relationships.

Engaged couples can apply for a prospective marriage visa.

Your relationship must be genuine and continuing

For your application to be considered the relationship needs to be genuine and continuing.

The department will consider factors such as:

  • Finances - joint ownership of property or assets, joint liabilities, sharing of household expenses etc. and
  • Social arrangements - living together (note you can be living separately at the time of application under certain circumstances), undertaking social activities together etc.

The relationship must be genuine. The department will take into consideration the opinions of friends and family of the couple when assessing the validity of the relationship.

Where does a Migration Agent fit into something seemingly simple like the above?

Well, relationships come in various formats and follow various pathways.

You might have had a religious upbringing with strict rules regarding your relationship.

Alternatively, you might have met on a social networking site such as Tinder; an online game platform such as World of Warcraft; or during a backpacking trip through South America.

Each and every relationship will have its own technical challenge when it comes to evidences. We ensure that we discuss your particular circumstances, so we can tailor-make you with your application.

If you meet the criteria

If you meet the criteria for a Partner visa you will initially be provided with a 2-year Bridging visa. This visa will allow you to reside in, and travel around, Australia, but understand that there may be limitations to being able to work or study in Australia, depending on any previous Australian visas you may have held.

As mentioned, Partner visas are not straightforward, and you need to make sure you follow the correct processes. Contact us today and let us discuss your particular circumstances, so we can help you with your application.
